These Terms of Service govern your use of the Pokestop website at pokestop.co.za and any purchases made through the website.

By using our website or placing an order, you agree to these Terms of Service, together with our Returns & Refunds Policy, Shipping & Delivery Policy and Privacy Policy.
Nothing in these Terms is intended to limit any rights available to consumers under applicable South African law.
1. Our store
Pokestop sells trading card games, sealed collectible products, accessories and related merchandise, including Pokémon TCG products.
Our products are intended for collectors, players and enthusiasts.
Product availability may change without notice.
2. Product information
We make reasonable efforts to ensure that product descriptions, images, prices and availability shown on our website are accurate.
Product images may sometimes be illustrative, and packaging may differ slightly due to manufacturer updates, regional variations or product revisions.
For sealed trading card products, Pokestop cannot guarantee the cards, rarity, value or pulls contained inside a product. Pack contents and pull rates are determined by the manufacturer.
3. Product availability
Adding an item to your cart does not reserve stock.
An order is only accepted once payment has been successfully processed and Pokestop has confirmed that the order can be fulfilled.
In the unlikely event that an item is unavailable after an order has been placed, we will contact you and arrange an appropriate refund, replacement or alternative where agreed.
4. Purchase limits
Certain high-demand or limited-release products may be subject to purchase limits.
Where a product page states a limit such as one per customer, customer, household or order limits may be enforced to help distribute limited stock fairly.
Pokestop reserves the right to cancel quantities placed above a clearly stated purchase limit and refund the affected amount.
Attempts to bypass limits through multiple accounts, orders or other methods may result in duplicate orders being cancelled.
5. Pricing
All prices are displayed in South African Rand unless stated otherwise.
Prices may change without notice.
The price applicable to your purchase is the price displayed when the order is submitted, subject to correction of genuine pricing or technical errors.
Where an obvious pricing error occurs, Pokestop may contact you before fulfilment to correct the order or provide a refund.
6. Payment
Orders must be paid using one of the payment methods available at checkout.
Payment services may be provided by third-party payment processors and are also subject to their applicable terms and security procedures.
Pokestop does not have access to your complete payment-card information where payment information is securely processed by Shopify or an authorised payment provider.
7. Order acceptance
After placing an order, you may receive an automated order confirmation.
This confirms that we have received your order but does not necessarily guarantee fulfilment.
Pokestop may refuse or cancel an order where reasonably necessary, including where:
- Payment has not been successfully completed
- Stock is unavailable
- A clear pricing or technical error has occurred
- A stated purchase limit has been exceeded
- We reasonably suspect fraud or misuse of the website
Where Pokestop cancels a paid order, any amount due back to the customer will be refunded.
8. Pre-orders
Products identified as pre-orders are products expected to be fulfilled at a future date.
Release and availability dates are estimates and may be changed by manufacturers, distributors or suppliers.
Where a release date changes, Pokestop will fulfil the order as soon as reasonably possible after stock becomes available.
Customer cancellation of pre-orders is governed by our Purchase Options Cancellation Policy and applicable South African consumer law.
If Pokestop is unable to fulfil a pre-order, the affected customer will be offered a refund.
9. Rip & Ship
Some products may be offered through Pokestop's Rip & Ship service.
By purchasing a Rip & Ship product and instructing Pokestop to open it, you authorise Pokestop to break the manufacturer's seal and open the product on your behalf.
Pokestop does not guarantee the cards, rarity, value or outcome of any Rip & Ship opening.
Once a Rip & Ship product has been opened at the customer's instruction, change-of-mind cancellation or return may no longer be available to the extent permitted by law.
This does not remove any statutory rights relating to incorrect orders, defective goods or other circumstances protected by applicable law.
10. Shipping and delivery
Shipping conditions, processing periods, free-delivery thresholds and estimated delivery times are set out in our Shipping & Delivery Policy.
Customers are responsible for providing accurate delivery and contact details.
11. Returns and refunds
Returns, damaged items, defective products, change-of-mind returns and refunds are governed by our Returns & Refunds Policy.
Nothing in these Terms removes any remedies available under applicable South African consumer legislation.
12. Promotions and discount codes
Promotional offers may be subject to additional conditions.
Unless otherwise stated:
- Promotions cannot be exchanged for cash
- Discount codes cannot necessarily be combined
- Promotional stock is subject to availability
- Pokestop may correct genuine technical or promotional errors
Any material promotion-specific conditions will be communicated with the relevant offer.
13. Website use
You may not use the website:
- For fraudulent or unlawful purposes
- To interfere with the website's operation or security
- To attempt unauthorised access to systems or customer information
- To scrape, reproduce or exploit website content unlawfully
- To place fraudulent orders or intentionally circumvent purchasing restrictions
We may restrict access where reasonably necessary to protect customers, Pokestop or the website.
14. Intellectual property
Unless otherwise stated, Pokestop's original website design, copy, graphics, branding and other original content are owned by or licensed to Pokestop.
Third-party trademarks, product names, artwork and intellectual property remain the property of their respective owners.
Pokémon and related trademarks and intellectual property belong to their respective rights holders. Pokestop is an independent retailer and does not claim ownership of third-party intellectual property.
15. Third-party services
The website may rely on third-party services including Shopify, payment gateways, courier companies, review platforms and other service providers.
Those services may occasionally experience outages, delays or technical issues outside Pokestop's direct control.
16. Liability
To the fullest extent permitted by law, Pokestop will not be responsible for indirect or consequential losses caused by circumstances outside its reasonable control.
Nothing in these Terms excludes or limits liability or consumer remedies that cannot lawfully be excluded under South African law.
17. Privacy
Personal information is handled in accordance with our Privacy Policy and applicable data-protection law, including the Protection of Personal Information Act where applicable.
18. Changes to these Terms
Pokestop may update these Terms from time to time.
The version published on the website at the time of an order will generally apply to that transaction, except where a change is required by law.
19. Governing law
These Terms and transactions with Pokestop are governed by the laws of the Republic of South Africa.
Where a dispute occurs, we encourage customers to contact us first so that we can attempt to resolve the matter fairly and promptly.
